RENTAL AGREEMENT
between Tod Millard trading as Campers Away [Owner] and
[insert full name, address, ‘phone, date of birth] [Renter].
Throughout this Agreement, all words in brackets [ ] have the same meaning as defined at the first appearance of the word in the Agreement.
By this Agreement, the Owner agrees to rent to the Renter, and the Renter agrees to rent from the Owner,

may also drive the Camper under the control and direction of the Renter, who is responsible for their acts while they are driving, and for fulfilling the Terms and Conditions of this Agreement.
Signature of this Agreement, consisting of 5 pages, confirms that it has been read and understood in its entirety, and that the parties are bound by its Terms and Conditions.

TERMS AND CONDITIONS
1. Your responsibilities:-
a. You [Renter] must look after the Camper and its keys. You must always lock the Camper and secure all its parts.
b. You must not let anyone work on the Camper without our [Owner‘s] permission. If we give you permission, we will only give you a refund if you give us a receipt for the work.
c. You must stop using the Camper and contact us as soon as you become aware of a fault with the Camper.
d. You must bring the Camper back to us by the end of the Rental, and we must check to see both it and its equipment are in good condition, and the Insurance and Breakdown documents are still present. The equipment is:-
COOKING UTENSILS; Two pots & Frying pan; Colander; Sharp knife; Chopping board; Veg peeler; Tin opener; Scissors; Grater; Tongs; Two serving spoons;
PLACE SETTINGS FOR 6; Dinner plates; Side plates; Bowls; Cutlery; Wine glasses; Juice glasses; Mugs;
CLEANING UP! Washing up bowl; Tea towels; Dustpan & brush.
e. You must only put unleaded petrol in the fuel tank of the Camper, and return the Camper with a full tank of petrol. If you do not, the cost of filling the tank will be deducted from your Security Deposit.
f. Animals or other pets must not enter the Camper, and smoking in the Camper is not permitted.
g. You must remove all your property from the Camper before returning it. If you do not, we cannot be responsible for its safe keeping, nor the cost of returning it to you.
h. You accept liability as owner, driver or operator of the Camper for:-
Any fixed penalty offence committed with respect to the Camper for the purposes of the Road Traffic Offenders Act 1988;
Any penalty charge notice issued in respect of the Camper under the London Local Authorities and Transport for London Act 2003;
Any excess charge or penalty charge for parking or for bus lane contraventions which may be incurred in pursuance of an order under sections 45 and 46 of the Road Traffic Regulation Act 1984 or under section 66 of the Road Traffic Act 1991 or under section 144 of the Transport Act 2000;
Any charges and penalty charges incurred under a road user charging scheme established pursuant to the Transport Act 2000, the Greater London Authority Act 1999 or the Transport (Scotland) Act 2001;
Any other penalty, charge or fine under any road traffic order in effect in any jurisdiction where the Camper is driven.
2. Use of the Camper:-
The Camper must not be driven or used:-
a. by anyone other than you and any Extra drivers;
b. by anyone without a full valid United Kingdom driving licence, and not between the ages of 25 and 70 years;
c. for hire and reward or any business purpose;
d. for any illegal purpose;
e. for racing, pace making, testing the Camper’s reliability and speed, or
teaching someone to drive;
f. while under the influence of alcohol or drugs;
g. outside Great Britain;
h. overloaded, or with more people than seatbelts;
i. to tow or propel any other vehicle or trailer;
j. other than on a paved public highway, private road or driveway;
k. to transport dangerous or noxious substances;
l. in a reckless or negligent manner.
3. Charges:-
You agree to pay:-
a. in advance of the Rental, the full costs of the Rental, calculated from our published tariff;
b. the cost of filling the fuel tank with unleaded petrol, if you fail to return the Camper with a full tank of fuel, as you have agreed;
c. all fines and court costs detailed in these Terms and Conditions, plus our reasonable administration costs for processing such matters;
d. in the event of the Camper being returned with Damage to it or its equipment, not detailed in this Agreement, all repair or reinstatement costs not covered by our insurance; plus any related towing, storage or impound fees; plus any resultant loss of income for no more than 30 days; plus a reasonable sum for reduction of value, if relevant; plus our reasonable administration costs for processing such matters;
e. our cleaning costs if you do not return the Camper in a reasonably clean condition, apart from normal external road and weather dirt.
4. Insurance:-
You and any Extra drivers, while using the Camper in Great Britain only, will be entitled to insurance as a co-insured (but not the policyholder) under our hirer drive policy, against claims from a third party alleging injury, death or damage to property as required by the Road Traffic Act 1988 or other legislation. You will be bound by the terms, conditions, limitations, exceptions and exclusions of this policy, and may request a copy of the policy before collecting the Camper.
5. Accidents, theft or loss, or breakdown:-
a. DO NOT admit responsibility to anyone in relation to an accident;
b. Collect names, addresses, ‘phone numbers and any other contact information for any witnesses to an accident, and for all parties involved in it, then pass these to us;
c. Show the Certificate of Motor Insurance, which we have left in the Camper, to all other parties involved in an accident, so they can record its details, and also give them your own personal details;
d. Make a very rough sketch of the accident, showing before and after positions of all vehicles, then as soon as convenient afterwards, write a brief description of what happened, then pass these papers to us;
e. Tell us about the accident, theft or loss at the earliest opportunity, confirming it in writing as soon as reasonably possible;
f. You or any Extra driver must send to us immediately, any document relating to any claim, or legal proceedings arising from the incident;
g. You must assist us and our insurers in every way, including allowing our insurers to defend any proceedings brought against you if they so wish, and including allowing proceedings to be brought in your name if required.
h. In the event of theft or loss, you must report the incident to the police as soon as discovered, and return the original keys to us as soon as reasonably possible.
i. In the event of breakdown, you must use our Automobile Association [AA] membership, as detailed in the document we leave in the Camper. If the AA cannot get you mobile, we will attempt to supply a replacement Camper subject to availability. If that is not possible, and you and the Camper must return to our base by AA Relay, we will refund to you the unused proportion of the Rental charge.
6. Renter’s own vehicle:-
You may leave your own vehicle[s] at our premises, subject to availability of space, and entirely at your own risk, as we can accept no liability for it or anything left in it, under any circumstances whatsoever. We recommend that if you must leave something in it, it is out of sight.
7. Personal data:-
a. You agree that we may verify personal, credit and driving information provided by you and any Extra drivers through credit agencies, the Driver and Vehicle Licensing Agency [DVLA], or other sources.
b. You agree that if you break this Agreement we can give this data to DVLA, debt collectors and any other relevant organisation.
8. Ending this Agreement:-
If you breach any of this Agreement we reserve the right to end it immediately, while retaining all other rights and remedies provided by law. We may repossess the Camper and charge you if we do this, and you will have no right to any compensation. If you continue to operate the Camper after the right to do so is terminated, you agree we have the right to notify the police the Camper has been stolen. You hereby release and discharge us from any liability arising from such notice.
9. Governing law:-
This Agreement is governed by the laws of England and any dispute may be settled in the Courts of England and Wales.
